Terms & Conditions
1. These terms and conditions are displayed at DB Tools' reception and are available upon request. They automatically take effect upon the customer's request for a repair or sales quote.
2. The cost of assessment is free of charge.
3. We need to physically assess all power tools for repair quotations, including the disassembly thereof.
4. If the quotation is declined, the tool will be returned unrepaired and disassembled. The quoted labor rate will apply for reassembly requests and will be treated without warranty. The tool will be stripped and discarded if not collected within 30 days.
5. DB Tools cannot be held liable for damage of injury of any nature in connection with non-working, reassembled tools returned to the customer.
6. DB Tools only uses original parts; lead times are subject to parts availability.
7. Any approximations of lead times or completion dates are estimates only and shall not be binding.
8. DB Tools shall not be liable for any damages, consequential damages, or economic loss due to long lead times and waiting periods.
9. DB Tools will perform a thorough inspection during the initial tool assessment but cannot be held liable for latent or additional defects.
10. Quotations are valid for 7 days and subject to stock availability unless otherwise stated.
11. DB Tools is not liable for any injury, including death or damage, resulting from machinery misuse, abuse, fair wear and tear, or damage caused by the customer, the customer's agent, employees, or representatives.
12. All Quotes are subject to the availability of goods or services, unintentional errors by DB Tools, and cost increases, including currency changes. Customers will be notified of any increases and can choose to accept or decline the updated quote.
13. The customer confirms that the goods and services on any invoice accurately represent the customer's order at the agreed prices. If delivery or performance has occurred, the customer has inspected the goods or services, is satisfied with the quality/quantity, and finds them free from defects.
14. All orders and agreed changes, whether made orally or in writing, are binding under these terms and cannot be revoked by the customer.
15. Quoted delivery and performance times are estimates only and not binding on DB Tools. DB Tools is not liable for any loss, damage, or consequential loss, including loss of profit, due to delays or failure to deliver caused by fire, explosion, machinery breakdown, government actions, strikes, war (declared or not), acts of God, or any events beyond DB Tools' control.
16. Repair times and repair costs are estimates only and are not binding on DB Tools.
17. Non-payment within 30 days upon receipt of invoice my result in the equipment being sold to cover any costs incurred, including but not limited to labor and parts.
18. New goods are guaranteed according to the Manufacturer's product-specific warranties only. Repairs workmanship is guaranteed to a professional degree for a period of 1 month and covers labor but not spare parts unless specified.
19. Liability under clause 18 is restricted to cost of repair or replacement of faulty goods or services or granting of credit at the sole discretion of DB Tools.
20. Any defective movable goods returned must be in their original or suitable packaging and accompanied by proof of purchase.
21. All guarantees are null and void if any goods are tampered with or used/stored outside the manufacture's specifications.
22. Under no circumstances will DB Tools be liable for any damage from neglect, misuse, or abuse of the goods and services.
23. The customer agrees to pay the amount on a DB Tools invoice unconditionally via Cash (preferred), direct bank transfer, or MasterCard of Visa debit/credit cards. DB Tools does not offer credit.
24. The customer has no right to withhold payment for any reason. No payment extension is permitted unless DB Tools agrees in writing, signed by an authorized DB Tools representative.
25. All goods supplied by DB TOols remain DB Tools' property until fully paid, regardless of attachment to property. The customer must not encumber the goods until payment is complete.
26. If an invoice is not paid in full within the agreed time, the customer agrees that DB Tools may take immediate action at the customer's expense, cancel the agreement, repossess any goods taken by the customer, remove any parts installed on the customer's machine, and claim damages.
27. The customer irrevocably authorizes DB Tools to enter the customer's premises to repossess any delivered goods and indemnifies DB Tools against any uncontrollable damage related to the removal of repossessed goods.
28. The customer consents that DB Tools shall have the right to institute any legal action in either the Magistrates Court or the local Division of the High Court at their sole discretion.
29. Any order is subject to cancellation due to acts of God or any circumstance beyond the control of DB Tools.
30. The customer agrees to indemnify and hold harmless DB Tools from any claims, damages, losses, or expenses arising from the customer's actions, misuse of goods, or any violation of these conditions.
31. In the event of ny disputes arising from these terms and conditions, the parties agree to attempt to resolve the matter amicably through mediation before pursuing any legal action. If mediation fails, the parties my then seek legal resource in accordance with applicable laws.
32. DB Tools reserve the right to modify these terms and conditions at any time. Customers will be notified of any changes, and continued use of DB Tools' services will constitute acceptance of the modified terms.
